Bank Account Freezes Under Scrutiny: Allahabad High Court Sets New Guidelines

The Allahabad High Court has issued directives to police and banking institutions regarding the freezing of bank accounts during cybercrime investigations.

The court has established a framework that restricts the blanket freezing of bank accounts, requiring investigative agencies to specify the exact amount suspected to be linked to a crime before taking action.
Police or investigating agencies cannot freeze an entire bank account without prior notice and justification.
They must identify and freeze only the suspected amount, allowing the account holder to maintain access to their legitimate funds.

The high court’s decision stems from multiple petitions filed by account holders alleging that their bank accounts had been frozen indefinitely without proper justification or notification.

In response, the court took serious note of these concerns and found that provisions under Section 106 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) were being misused in several instances.
The court issued clear directions to police and banks, requiring them to specify in writing the exact amount suspected to be linked to criminal activity before freezing funds.
Affected individuals must be informed about such action, enabling them to exercise their legal rights.
Individuals have the right to approach the jurisdictional magistrate to seek de-freezing of their accounts if they believe the action is unjustified.

Experts welcome the judgment, calling it a balanced approach between effective investigation and protection of citizens’ rights.

Prof. Triveni Singh, a renowned cybercrime expert and former IPS officer, noted that while swift action is essential in cybercrime cases, it should not come at the cost of citizens’ legitimate rights.
